Typically recovery action can be started on outstanding amounts for arrears and defaults as much as six years after the debt was incurred per the Limitation of Actions Act 1958. Certain circumstances under the act allow for the time period to be extended beyond six years from the date of the incurrence of the debt. If judgment has been given in relation to the debt, enforcement of the judgment may continue for fifteen years beyond the date of the judgment. Where interest was claimed in the originating procedure and in the enforcement process, interest will remain recovable based on the outstanding amount of the judgment.

All service of documents includes duly sworn affidavit of service in the form required per the respective Court or Tribunal of origin or reporting as required. For Clients requiring specialized form of affidavit per their needs, we can accommodate the requirements of the Client individually. When serving documents in Queensland that were filed in another state, a notice as to interstate service is usually required to be served along with the document in line with the Service and Execution of Process Act 1992. Failure to serve a notice in relation to interstate service may void the validity of service of the document when attempting to proceed with your matter. Please refer to the relevant legislation for your document type to ensure the appropriate notice is attached as to interstate service.
