We specialise in Family Dispute Resolution (FDR). FDR Practitioners are specialist mediators who work to provide the community with an alternative to expensive litigation and court appearances when couples end their relationships.
FDRP's negotiate and write parenting plans with separated couples; we negotiate access arrangements between parents and other significant adults in a child's life. We work with clients to help resolve issues that are preventing an amicable arrangement and we negotiate the financial settlements of separating couples. All agreements reached in FDR must comply with the Family Law Act and can be formalised into Consent Orders if required. 80% of our clients walk away with an agreement.
FDRP's are trained in family law and hold degrees in other complementary disciplines such as Psychology. We are registered with the Attorney General Department and are subject to stringent practice rules and guild lines. We are not Solicitors; our aim is to resolve conflict and bring matters to as amicable an agreement as possible.
Bayside Mediation offers Child Inclusive Mediation (consider best practice worldwide) We are a child focused practice, always mindful of the developmental needs of the children we are advocating for. For difficult matters we offer Shuttle Mediation and we can mediate when parties are interstate or overseas. We have our own purpose-built rooms in Highett, where we offer a comfortable, safe, non-threatening environment to negotiate safely and with confidence.
FDR's issue the 60 (I) certificate needed to take a matter to court. If a children's matter proves inappropriate for mediation or the matter cannot be resolved via mediation, then the separating couple need a 60 (I) certificate to verify that fact, so they can proceed to court.
Mediation is non-adversarial, it costs less, is more expedient, and in many cases more effective because the couple have negotiated the outcome for themselves rather than having an arbitrary legal professional decide for them. Mediation is the way forward.
